Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Phantoma.ai platform and services. This AUP is incorporated into and forms part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

1. What Phantoma Does and Does Not Do

Phantoma is an AI-powered platform for generating faceless short-form video content. Understanding how our platform works is essential to understanding this policy:

• Generic synthetic voices only. All voices available within Phantoma are pre-built, generic synthetic voices provided by our third-party AI partners. We do notoffer voice cloning, voice replication of real individuals, or any feature that reproduces a specific person's voice.
• No real people depicted. Generated videos use AI-created imagery and licensed stock media. The Services do not generate depictions of identifiable real people, and do not support avatar creation based on real individuals.
• Faceless content by design. Phantoma is purpose-built for faceless video content — topic research, script generation, thumbnail creation, and video production — for legitimate use cases such as social media marketing, educational content, product demonstrations, and explainer videos.
• Human review expected. While our AI automates the production pipeline, users are expected to review all generated content for accuracy, quality, and compliance before publishing.

2. Prohibited Content

You may not use the Services to create, distribute, store, or promote any of the following:

Identity and Likeness

• Deepfakes or synthetic depictions of identifiable real people
• Voice cloning or imitation of real individuals' voices
• Content that impersonates real people, organizations, or government entities
• Non-consensual use of any person's name, likeness, or identity

Harmful and Illegal Content

• Content that is illegal in any applicable jurisdiction
• Child sexual abuse material (CSAM) or any content exploiting or endangering minors
• Content promoting terrorism, violent extremism, or radicalization
• Content promoting self-harm or suicide
• Content promoting violence, hatred, harassment, or discrimination based on protected characteristics

Deception and Manipulation

• Misinformation or disinformation deliberately designed to deceive
• Content designed to manipulate elections, voting, or democratic processes
• Fraudulent or deceptive commercial practices
• Phishing, scams, or social engineering
• Content intended to deceive viewers into believing it was created by a human without AI involvement, where such disclosure is required by applicable law or platform policy

Intellectual Property

• Content that infringes copyrights, trademarks, or other intellectual property rights of third parties
• Unauthorized reproduction of protected works

Other Prohibited Uses

• Spam, bulk unsolicited content, or unauthorized commercial solicitations
• Sexually explicit or pornographic material
• Malware distribution or content designed to compromise computer systems
• Circumventing or attempting to circumvent any content filtering or safety features of the Services

3. Your Obligations

When using the Services, you agree to:

• Review before publishing. Review all AI-generated content for accuracy, quality, and appropriateness before publishing or distributing it.
• Verify factual claims. AI-generated scripts may contain inaccuracies. You are responsible for verifying any factual claims in generated content.
• Disclose AI involvement. Clearly disclose that content was AI-generated when publishing on platforms that require such disclosure, including but not limited to YouTube, TikTok, Instagram, and Facebook, each of which has AI content labeling policies.
• Comply with applicable laws. Comply with all applicable laws and regulations, including the EU AI Act, applicable US state synthetic media laws, and the content policies of the platforms where you publish.
• Respond to removal requests. Promptly remove content if notified that it violates this AUP or the rights of a third party.

4. How We Enforce This Policy

We maintain content moderation practices to promote the safe and responsible use of the Services:

• Automated safeguards. User prompts and topics are screened against our content policies before processing.
• Content review. We reserve the right to review generated content for compliance with this AUP and our Terms of Service.
• User reports. Anyone may report potential violations by contacting us at support@phantoma.ai.

Violations are handled through graduated enforcement:

• First minor violation: Warning and content removal.
• Second violation or serious first violation: Temporary account suspension.
• Severe or repeated violations: Permanent account termination.
• Illegal content: Immediate termination and report to law enforcement where required.

Appeals. You may appeal an enforcement action by contacting support@phantoma.ai within 14 days of the action. We will review your appeal and respond within 10 business days.

5. Regulatory Compliance

This AUP is designed to align with applicable AI regulations, including:

• EU AI Act transparency obligations (effective August 2026), which require disclosure of AI-generated content.
• US state synthetic media laws, including but not limited to the Tennessee ELVIS Act and similar legislation in other states addressing deepfakes and voice rights.
• Platform-specific AI disclosure policies from major social media platforms.

Users in jurisdictions with specific AI disclosure requirements are responsible for compliance when publishing content generated through the Services. We may update this AUP to reflect new legal requirements as they take effect.

6. Changes to This Policy

We may update this Acceptable Use Policy from time to time. We will notify you of material changes by posting the revised policy on this page and updating the "Last updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised policy.
